數據產業是利用數據技術，對數據資源進行產品和服務開發過程中所形成的產業形態，是促進數據要素市場化價值化的新興產業。這個產業的經營主體主要包括從事數據技術創新、資源開發利用、數據技術賦能應用的企業，同時也包括從事數據產品和服務流通交易的企業，以及數據基礎設施建設的企業。培育數據產業是數據要素市場化配置改革的一項重要內容，也是培育數字經濟、發展新質生產力的一個重要環節。當前，我國數據產業處于快速發展階段，市場空間大，已成為數字經濟發展的新增長點。

“十四五”以來，我國數據產業規模快速增長。據國家數據發展研究院研究，2024年，全國數據企業數量超過40萬家，數據產業規模達5.86萬億元，較“十三五”末增長117%；截至2024年底，我國軟件收入規模較2020年增長80%，規模以上電子信息制造業增加值增長超70%。
